Is Your Company Compliant With the New OHS Requirements?"},"content":{"rendered":"<p class=\"isSelectedEnd\">Bill 27 and the modernization of Quebec\u2019s occupational health and safety regime have been discussed for several years now.<\/p>\n<p class=\"isSelectedEnd\">For a long time, many employers felt the changes were still far off.<\/p>\n<p class=\"isSelectedEnd\">New regulations to understand. Changes to prepare for. New mechanisms that would eventually need to be implemented.<\/p>\n<p class=\"isSelectedEnd\">Since October 1, 2025, Quebec\u2019s permanent prevention and worker participation regime has been in effect. Nearly all employers were given one year to develop and implement their occupational health and safety prevention program or action plan and to ensure that psychosocial risks were incorporated into it.<\/p>\n<p class=\"isSelectedEnd\">That deadline arrives in October 2026.<\/p>\n<p class=\"isSelectedEnd\">And for organizations that are not yet ready, time is running out.<\/p>\n<p>&nbsp;<\/p>\n<h2>Bill 27: What Needs to Be in Place?<\/h2>\n<p class=\"isSelectedEnd\">The new OHS requirements are not simply about producing another document and filing it away. The objective is to establish a structured and effective prevention process within the organization.<\/p>\n<p class=\"isSelectedEnd\">The specific requirements vary depending on the size of the establishment.<\/p>\n<ul data-spread=\"false\">\n<li>Establishments with <strong>19 workers or fewer<\/strong> must, among other things, develop and implement an occupational health and safety action plan.<\/li>\n<li>Establishments with <strong>20 workers or more<\/strong> must instead implement a prevention program.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">In both cases, the principle remains the same:<\/p>\n<ul data-spread=\"false\">\n<li>identify workplace hazards and risks;<\/li>\n<li>determine what needs to be corrected or controlled;<\/li>\n<li>establish concrete measures and ensure proper follow-up.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">In other words, it is no longer enough to say, \u201cWe already take care of health and safety.\u201d Employers need to be able to demonstrate how prevention is actually structured within their organization.<\/p>\n<p>&nbsp;<\/p>\n<h2>Psychosocial Risks Are Now Part of the Equation<\/h2>\n<p class=\"isSelectedEnd\">Another important change is that prevention is no longer limited to physical hazards.<\/p>\n<p class=\"isSelectedEnd\">Employers must also take <strong>psychosocial risks<\/strong> into account as part of their workplace prevention approach.<\/p>\n<p class=\"isSelectedEnd\">These may include factors related to work organization, stress, violence and harassment. Quebec\u2019s Act respecting occupational health and safety also specifies that psychosocial risks include risks related to sexual violence.<\/p>\n<p class=\"isSelectedEnd\">This is particularly important because many organizations already have well-established OHS procedures for physical hazards but have far less structure when it comes to psychosocial risks.<\/p>\n<p class=\"isSelectedEnd\">And this is often where gaps begin to appear.<\/p>\n<p class=\"isSelectedEnd\">To learn more: <a href=\"https:\/\/santinel.com\/en\/psychosocial-risk-prevention-managers\/\">Preventing Psychosocial Risks in the Workplace: The Role of Managers in 2026<\/a><\/p>\n<p>&nbsp;<\/p>\n<h2>Health and Safety Committee, Representative or Liaison Officer: Is Your Organization Properly Structured?<\/h2>\n<p class=\"isSelectedEnd\">The Act to modernize the occupational health and safety regime also provides for various worker participation mechanisms.<\/p>\n<p class=\"isSelectedEnd\">Depending on the size and circumstances of your establishment, this may include:<\/p>\n<ul data-spread=\"false\">\n<li>a health and safety committee;<\/li>\n<li>a health and safety representative;<\/li>\n<li>or a health and safety liaison officer.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">The number of workers in an establishment plays an important role in determining which mechanisms apply. For example, an establishment with 19 workers or fewer must designate a health and safety liaison officer, while establishments with 20 workers or more are subject to other participation mechanisms, including a health and safety representative and a health and safety committee, where applicable.<\/p>\n<p class=\"isSelectedEnd\">Certain individuals appointed to these roles must also complete the training required under the regulations.<\/p>\n<p class=\"isSelectedEnd\">For members of health and safety committees and health and safety representatives who were already designated in Level 4 establishments, the training deadline is October 2026.<\/p>\n<p class=\"isSelectedEnd\">The question, then, is not simply whether you have \u201csomeone responsible for health and safety.\u201d You need to know whether the appropriate mechanisms are actually in place.<\/p>\n<p>&nbsp;<\/p>\n<h2>And If You Think You Are Compliant\u2026 Are You Sure?<\/h2>\n<p class=\"isSelectedEnd\">This is probably the most important question employers should be asking themselves today.<\/p>\n<p class=\"isSelectedEnd\">You may already have several good practices in place.<\/p>\n<p class=\"isSelectedEnd\">Training is provided.<\/p>\n<p class=\"isSelectedEnd\">Inspections are carried out.<\/p>\n<p class=\"isSelectedEnd\">Policies have been developed.<\/p>\n<p class=\"isSelectedEnd\">You may even have a health and safety committee.<\/p>\n<p class=\"isSelectedEnd\">But does all of this actually meet the new OHS requirements applicable in Quebec in 2026?<\/p>\n<p class=\"isSelectedEnd\">Some compliance gaps are less obvious than you might think.
